Suggested Interview Questions
Note: An attorney who does not specialize
in divorce is able to take your case. If so, some of the following questions
may be more important.
- Do you specialize in divorces, or are divorces just
a part of your practice?
- Have you litigated divorce cases? If so, how many?
- Have you mediated or settled divorce cases?
- Is our communication privileged?
- How quickly do you respond to phone calls, e-mails,
etc.? How is communication billed?
- Do you have experience with domestic violence, abuse
(including but not limited: upscale, emotional, physical and sexual),
alcoholism, division of privately owned business, proof of income
for self-employed, sexual addiction, gay/custody issues, lesbian issues,
(or whatever your particular concern may be)?
- Are you personally handling my case or will an associate
or paralegal be
working with me?
- Are you familiar with the judges in my county of
litigation?
- Do you have experience in that my particular case
will require?
- What is your policy for keeping me informed of the
status of my case?
- What is your preferred method of setting disputes?

- How will you charge me? What is your hourly rate?
Do you charge for the time I spend with other lawyers, with paralegals,
and/or with secretaries? If so, at what rate? Do you charge for faxes,
copies, and long-distance telephone calls? How much?
- Do you require a retainer, or do you allow payments
as services are rendered? If I can’t get to the marital money, what
are my payment options? Is your retainer refundable?
- Are there tasks that I can do myself to cut down
on the amount you will charge me?
- If I decide at any point I'd like to take
control and negotiate directly with my spouse or with my spouse's
lawyer to save money, will you let me do that, using you as a coach?
Or will you insist that all communications flow through you? How do
you feel about unbundling of legal services in divorce?
